Agreement

These terms are between you and FastSMSOnline, operating from Accra, Ghana. By creating an account or sending a message you accept them. If you are accepting on behalf of an organisation, you confirm you are authorised to do so.

Your account

You are responsible for your account and everything sent from it.

Give accurate registration details and keep them current.
Keep your password confidential — anyone with it can send at your expense.
Tell us promptly if you believe your account has been compromised.
You must be at least 18, or have authority to bind the organisation you represent.

Credits and payment

SMS credits are bought in advance and deducted as messages are sent.
Credits do not expire.
A message part accepted by the mobile network is charged, whether or not it is ultimately delivered to the handset.
Prices may change, but changes never affect credits already purchased.
Credits have no cash value and are not transferable between accounts.
Refunds of unused credits are considered case by case — write to hello@fastsmsonline.com.

Acceptable use

You may not use FastSMSOnline to send:

Messages to people who have not consented to receive them, where consent is required.
Fraudulent, deceptive or phishing messages, including anything impersonating another person or organisation.
Content that is unlawful, obscene, threatening, harassing or defamatory.
Unsolicited bulk marketing to purchased, scraped or otherwise unconsented lists.
Anything that breaches the rules of a mobile network or the laws of Ghana.

You must honour opt-out requests promptly, and you must not use a sender ID you have no legitimate claim to.

We may suspend or close an account that breaches this section, without refund.

Sender IDs

Sender IDs are subject to review and to mobile network approval, which we do not control. A sender ID may be rejected, or withdrawn after approval, if a network requires it. Until yours is approved, messages are sent using the platform default sender ID.

You confirm you have the right to use any sender ID you request.

Service availability

We work to keep FastSMSOnline available, but we do not guarantee uninterrupted access. The service may be unavailable during maintenance, or because of failures at a mobile network, payment provider or infrastructure supplier.

Message delivery depends on mobile networks and on the recipient’s handset. We cannot guarantee that any particular message will be delivered, or the time it will take.

Your content

The messages you send and the contacts you upload remain yours. You grant us only the permission needed to transmit, store and display them in order to provide the service.

You are responsible for the content of your messages and for having a lawful basis to contact your recipients.

Limitation of liability

To the fullest extent permitted by law, FastSMSOnline is not liable for indirect or consequential loss, including lost profit, lost business or lost opportunity arising from undelivered or delayed messages.

Our total liability for any claim is limited to the amount you paid us in the twelve months preceding it.

Nothing here excludes liability that cannot lawfully be excluded.

Suspension and termination

You may close your account at any time by writing to us. We may suspend or close an account that breaches these terms, that is used unlawfully, or where we are required to do so.

On closure your access ends. Unused credits are handled under the refund position above.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed, and material changes will be notified to account holders by email. Continuing to use the service after a change means you accept it.

Governing law

These terms are governed by the laws of Ghana, and the courts of Ghana have exclusive jurisdiction over any dispute.
